The term “Black Car” in New York State is synonymous with professional, pre-arranged car services, a vital part of the state’s transportation network. To support the drivers behind these black car services, the New York Black Car Operators’ Injury Compensation Fund was established in 1999. This initiative, signed into law by Governor George Pataki in May of that year, was designed to provide crucial Workers’ Compensation coverage and additional benefits to black car operators throughout New York.
Officially launched with the billing and collection system in October 1999, and the full Workers’ Compensation coverage commencing in January 2000, The Black Car Fund has become an essential safety net for drivers. Although its formal name remains the New York Black Car Operators’ Injury Compensation Fund, it is widely recognized and referred to as simply The Black Car Fund.
The scope of The Black Car Fund is extensive, covering drivers affiliated with Member Bases across New York State. A significant 98% of these bases are located within the bustling New York City Metropolitan area. Membership for bases is determined by specific criteria, primarily focusing on those deriving over 90% of their business from non-cash, pre-arranged payments. This definition purposefully excludes central dispatch facilities that have substantial ownership stakes in the dispatched vehicles. Importantly, even black car and limousine companies based outside of New York State are mandated to join The Black Car Fund if they operate within the state and meet the statutory requirements.
Funding for The Black Car Fund is generated through a passenger surcharge. This small additional fee is applied to each fare, collected by the Member Bases from their clientele, and subsequently remitted to The Fund. This system ensures a steady stream of income to support the benefits provided to drivers.
Today, The Black Car Fund stands as a robust organization, encompassing nearly 400 Member Bases. Collectively, it provides Workers’ Compensation coverage to over 130,000 affiliated drivers, safeguarding the well-being of a significant portion of New York’s black car service workforce.
